Continued Public Hearing of
October 6, 2004

I.      CALL TO ORDER - 8:00 p.m.

        Chairman Philip Lindquist advised all present that the meeting was being tape recorded and reviewed the agenda for the public hearing. He asked if all abutters had been properly notified and was advised by Administrative Assistant Barbara Ferguson that certified mail receipts for all abutters had been received by the Planning Board office including a certified receipt for the abutter who was not notified of the September 15, 2004 session causing the public hearing to be continued. Vice Chairman Gerard LeBlanc read the following public hearing notice published in The Hanson Express on August 26 & September 2, 2004.

PUBLIC HEARING NOTICE

        The Hanson Planning Board will hold a public hearing on Wednesday, September 15, 2004 at 8:00 p.m. in the Hanson Town Hall, 542 Liberty Street, Hanson, MA on a definitive subdivision plan showing a 10-lot residential subdivision Off Whitman Street.  The plan is further identified as Lot 7 on Assessors Map 102 and Lot 18A-4 on Assessors Map 102.  Deed to said property is recorded in Plymouth District Registry of Deeds, Book 623, Page 465 and Book, 25332, Page 2. The subdivision, entitled Deer Hill Road Extension, is located in Hanson, MA and dated July 23, 2004 by Merrill Associates, Inc., 427 Columbia Road, Hanover, MA 02339. The plan was submitted by A.W. Perry South, Inc., 20 Winthrop Square, Boston, MA 02110.  A copy of the subdivision plan is available in the Hanson Town Clerk’s Office and in the Planning Board office for review.

II.     Presentation of plans from applicant/engineer

        Representing the applicant, A.W. Perry South, Inc. were Peter Palmieri of Merrill Associates of Hanover, Richard P. Beal, Asset Manager for A.W. Perry, Inc. of Boston, and Jay and Paul Gallagher of J.P. Gallagher Construction & Development Co., Inc. of Hanover. Mr. Palmieri told the Board that the plans call for the construction of nine lots in addition to the six previously approved for the abutting Deer Hill subdivision.   Of the 11.25 acre parcel, he said, 1.9 acres are wetlands.  The topography of the property, he said, slopes towards the wetlands. The plans call for the elimination of the cul-de-sac shown on the plans for Deer Hill and as well as an existing detention basin.  Two new basins, he said, will be constructed at the end of each of the cul de sacs shown on the plan for Deer Hill Road Extension. He said that he met with the Water Department and a plan has been drawn depicting the looping of an eight inch ductile water main through the Deer Hill and Deer Hill Road Extension subdivisions.  Mr. Palmieri said that he had obtained copies of the memorandums sent to the Board by the department heads as well as the review done by the Board’s engineer for the project, Land Planning, Inc. of Hanson, and had addressed all their concerns on the revised plan under discussion.  The requested waivers from the Board’s rules and regulations, he said, are from Section 6.5.6, length of dead end street; Section 6.6, depth of cover over drainline; and Section 7.4.44, drain outfall within 65 feet of way line and use of flared end section.

        Clerk David Nagle read the names of all the abutters on the list certified by the Board of Assessors giving each an opportunity to offer comments or ask questions:

        Charles & Barbara Soul - Charles Soul asked whether an egress waiver for distance was needed for a road that long when it is the only access and egress for a development and was told it is not a requirement.  He expressed concern with potential drainage problems related to the construction of 15 new homes in an area where there are already problems.

        Brian & Karen Downey - Brian Downey asked what the impact of the waivers granted for Deer Hill would be on Deer Hill Road Extension and was told by Chairman Lindquist that, in his opinion, they will not impact Deer Hill Road Extension.

        Melody Lindsay - Speaking for Melody Lindsay, John Aiello asked whether a Notice of Intent had been submitted to the Conservation Commission and was told that it had. He also asked about a bond and was told that it will be required for completion of the project.

        Joseph & Anna Walsh - Joseph Walsh said that the construction of the roadway for his Deer Hill subdivision has already begun.  Chairman Lindquist said that the two projects are separate and will be bonded separately.  Town Planner Noreen O’Toole and Chairman Lindquist explained the process for the acceptance of streets by the town when projects have been completed.

        Anne Keene - Anne and Roger Keene expressed concern about a brook and was told by Mr. Palmieri that the stream is off his client’s property.

        Cristyl & Jon Patterson -  Jon Patterson asked how the current water ban would effect the project and was told that the water main would be for fire protection only.  All of the houses will have their own wells.

        Dennis & Ellen Laversa - Dennis Laversa said that there are springs to the rear of the property.  He said that he was concerned about drainage.  Mr. Palmieri explained that some of the runoff from Deer Hill would be going into the drainage system for Deer Hill Road Extension which ultimately drains into the wetlands. Mr. Palmieri gave the Board the drainage calculations for both basins for two to 100 year storms. Mr. Laversa said that the wetlands ultimately feed into the aquifer which will be impacted by chemicals from the road runoff as well as septic systems in the development.   Mr. Palmieri said that the project exceeds water quality standards. Mr. Laversa said that he also has safety concerns from the increased traffic the subdivision will create.

        Roger Keene - Roger Keene asked about stone walls and was told by Mr. Palmieri that there is just one on the site. He expressed concern about fill around foundations and the impact it could have on the abutters.  He said he feared that his family was going to be pushed out of town by this development. Mr. Lindquist explained that state law allows property owners to develop their land as long as they follow the rules and regulations promulgated by the local Planning Board.

V.      Questions/Comments from other Town Boards/Departments

        A.      Police Department

                Clerk David Nagle read a September 8, 2004 memorandum from Police Lieutenant Richard Gredler indicating he had no public safety concern with the plans for the subdivision.

        B.      Water Department

                Mr. Nagle read a September 14, 2004 memorandum from Water Superintendent Glen Doherty stating that the water main on the subdivision needs to be re-worked to include the Deer Hill project.

        C.      Fire Department

                Mr. Nagle read a September 7, 2004 memorandum from Fire Chief Allen Hoyt stating that hydrants should be moved to keep them all at an approximate spacing of 300 feet.

        D.      Board of Health

                The Board received no response to its July 23, 2004 request for comments.
        
        E.      Building Inspector

                Mr. Nagle read a September, 2004 memorandum from Building Inspector Michael Kennedy noting that the rear setback in not configured for Lot 7 so he is unable to determine whether the proposed dwelling will be on Deer Hill or Fawn Lane.

        G.      Conservation Commission

                Mr. Nagle read a September 15, 2004 memorandum from the Conservation Commission indicating no comments as the Commission had not yet received a filing for the proposed subdivision. Mr. Palmieri said that a Notice of Intent has been submitted.

        H.      Highway Surveyor

                The Board received no response to its July 23, 2004 request for comments.

VI.     Questions from Planning Board Members

        Gerard LeBlanc said that his concerns had been addressed

        Joan DiLillo said that she hoped the drainage calculations were correct based on the impact Birchbark Lane and Forest Trail had on the area.

        David Nagle noted that the drainage system for Deer Hill was designed to reduce existing drainage problems.  He said he was not sure that the same could be said for this subdivision. He said that he too hoped the calculations held up.  He asked if the developers of both projects were working together to make the final project look like one subdivision and was told that there will be a homeowners’ association and mutual covenants for aesthetics.   Mr. Nagle asked about the possibility of a park and was told that one would not be possible due to the extent of the wetlands.

VII.    Comments from Board’s Engineer

        Board members noted a September 14, 2004 letter from Land Planning, Inc. of Hanson, its review engineer on the project.  Mr. Palmieri said that the revised plan addresses all the comments contained in that letter.  Chairman Lindquist read an October 6, 2004 letter from Land Planning in which Project Engineer Steven Wry indicated that, although the revised plan accounts for the large majority of comments noted in the September 15, 2004 letter, he had not had sufficient time to review some technical changes such as the Addendum to the Stormwater Management Report and Hydrologic-Hydraulic Analysis.
